1. Purpose and Functionality

The AI agent “EVA” is a software-based assistance system developed by Ehrhardt + Partner GmbH & Co. KG.
EVA is designed to provide automated responses to inquiries and general support in corporate communications.
To do so, EVA uses language and text models from OpenAI, L.L.C. to generate context-based answers based on the content entered by users.

The information provided by EVA is machine-generated and may contain inaccuracies, omissions, or misinterpretations. The system does not replace personal consultation or legally binding advice.

2. No Legal, Professional, or Business Advice

EVA provides general information only.
All generated responses are intended to assist users, not to serve as binding decision-making guidance.
They do not constitute legally binding, technical, commercial, or professional advice.
Users remain solely responsible for evaluating, verifying, and applying the information provided.

3. Data Protection and Data Processing

The processing of personal data by EVA is carried out in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).
User inputs (e.g., text, questions) are processed solely for the purpose of generating responses and are transmitted via encrypted connections (TLS) to the systems of OpenAI, L.L.C.
Data processing is based on a data processing agreement (DPA) between Ehrhardt + Partner GmbH & Co. KG and OpenAI, L.L.C. pursuant to Art. 28 GDPR.

Personal data is not stored permanently unless required for handling a specific request or improving system quality.

4. Disclaimer of Liability

Use of EVA is at the user’s own risk.
Ehrhardt + Partner GmbH & Co. KG accepts no liability for:

• the accuracy, completeness, or timeliness of content generated by EVA,

• possible misinterpretations, incomplete, or ambiguous responses,

• direct or indirect damages resulting from the use or non-use of the provided information,

• technical failures, system errors, or disruptions caused by external services (in particular by OpenAI).

Any warranty regarding availability, error-free operation, or suitability of the system for a specific purpose is excluded.

5. Copyright

The content provided by EVA is, where applicable, subject to the copyrights of Ehrhardt + Partner GmbH & Co. KG or the respective rights holders.
Reproduction, distribution, or commercial use of the generated content outside the defined operational purpose is prohibited without express written permission.

6. Amendments

Ehrhardt + Partner GmbH & Co. KG reserves the right to modify or expand this disclaimer as well as the functionality and scope of EVA at any time, particularly in the event of technical developments or changes in legal requirements.

7. Applicable Law

The law of the Federal Republic of Germany shall apply.
The place of jurisdiction, insofar as legally permissible, is Koblenz.
